Ruling by the Court of Last Instance in Eric Sautedé’s case

The Macau Court of Last Instance passed its final decision on the appeal filed by Eric Sautedé, a lecturer of political science licensed in 2014 by the catholic university (Universidade de São José – USJ) for reasons pertaining to the exercise of his academic freedom. Although the subject decision was against the academician and confirmed the termination of his contract as permitted in strict legal terms, the position of the judges was not unanimous and, in a declaration of vote, one of the judges considered USJ’s decision as arbitrary and the solution as inadequate and abusive.

We are very proud that FCLaw’s partner Miguel Quental defended Eric Sautedé in this prolonged case that served also as a source of discussion and debate in the Macau society on central matters such as individual rights and freedom and, in general, on the status quo of the local labour law.

FCLaw’s early insight on local gaming law ultimately confirmed by the TUI

The Court of Last Instance of Macau (TUI) recently passed a decision whereby it affirms the liability of the gaming concessionaires towards third parties for the activity performed in the casinos by gaming promoters. In its judgement of last 19 November 2021, the TUI ultimately clarified this highly relevant matter for the Macau gaming industry and confirmed the insight of FCLaw lawyers Paulo Cordeiro de Sousa and Rodrigo Mendia de Castro in their piece as early as May 2017 for the Asian Gaming Lawyer Review

The local press featured an article making reference to a decision by the Court of Last Instance of Macau (TUI). In a final decision, the TUI sustained that there had been no just cause in the dismissal of Chef António Neves Coelho and therefore the plaintiff’s discharge had been illegal.

FCLaw is proud that Miguel Quental, partner and head of FCLaw’s Labour Department acted as counsel to Chef António Neves Coelho, who is an honoured and esteemed local figure, in addition to being a long-term award winning and acclaimed chef and restaurateur.
